1. Acceptance of Terms

Welcome to CalendarShot. By accessing or using our progressive web application (PWA) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you and CalendarShot ("we," "our," or "us"). We reserve the right to update these Terms at any time, and your continued use of the service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

CalendarShot is an AI-powered service that:

• Extracts calendar events from images you upload (such as work schedules, appointment cards, and calendar screenshots)
• Uses artificial intelligence and vision models to interpret and structure calendar information
• Allows you to sync extracted events with third-party calendar services (Google Calendar, CalDAV, etc.)
• Provides tools to manage and edit extracted calendar events

The service is provided on an "as is" and "as available" basis. We continuously work to improve accuracy and performance but make no guarantees about extraction accuracy or service availability.

3. User Accounts

3.1 Account Registration

To use CalendarShot, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 13 years old to use CalendarShot. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion with or without notice

You may delete your account at any time through your account settings.

4. Acceptable Use

4.1 Permitted Use

You may use CalendarShot for lawful purposes to extract and manage calendar events from your own images or images you have permission to process.

4.2 Prohibited Activities

You agree NOT to:

• Upload images containing illegal, harmful, or offensive content
• Process images you do not have permission to use
• Violate any person's privacy rights or intellectual property rights
• Use the service to send spam or unsolicited communications
• Attempt to reverse engineer, decompile, or disassemble the service
• Use automated systems (bots, scrapers) without our written permission
• Interfere with or disrupt the service or servers
• Bypass any security features or access controls
• Use the service for any unlawful purpose or in violation of any regulations
• Impersonate another person or entity
• Upload malware, viruses, or other harmful code

5. User Content

5.1 Your Content

You retain all rights to the images and content you upload to CalendarShot ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, worldwide license to:

• Process your images using AI vision models to extract calendar information
• Store extracted event data in your account
• Sync events to your connected calendar services as you direct
• Display and modify content as necessary to provide the service

This license ends when you delete your content or account, except where we must retain data for legal or security purposes.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to upload and process the content
• Your content does not violate any laws, regulations, or third-party rights
• Your content does not contain malware or harmful code

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

6. Intellectual Property

6.1 CalendarShot's Rights

CalendarShot and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Trademarks

"CalendarShot" and related logos are our trademarks. You may not use our trademarks without our prior written permission.

6.3 Feedback

If you provide us with feedback, suggestions, or ideas about CalendarShot, you grant us the right to use such feedback without any obligation to you.

7. Third-Party Services

CalendarShot integrates with third-party calendar services (Google Calendar, CalDAV, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for:

• The availability, functionality, or security of third-party services
• Changes or discontinuation of third-party services
• Any loss of data or functionality due to third-party service issues
• Third-party service terms, privacy policies, or practices

You are responsible for maintaining your accounts with third-party services and complying with their terms.

8. Fees and Payment

CalendarShot may offer both free and paid service tiers. If you subscribe to a paid plan:

• You agree to pay all fees associated with your subscription
• Fees are billed in advance on a recurring basis (monthly, annually, etc.)
• All fees are non-refundable except as required by law
• We may change fees with 30 days' notice
• You are responsible for providing valid payment information
• Failure to pay may result in service suspension or termination

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using CalendarShot, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and use of your information as described therein.

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimers

CALENDARSHOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy or completeness of event extraction from images
• Uninterrupted, secure, or error-free service operation
• Fitness for a particular purpose
• Non-infringement of third-party rights
• Compatibility with your devices or software

10.2 AI Accuracy

CalendarShot uses AI and machine learning models to extract calendar information. While we strive for accuracy, we cannot guarantee that:

• All events will be correctly identified
• Event details (dates, times, locations) will always be accurate
• The service will work with all image types and formats

You are responsible for reviewing and verifying all extracted events before syncing to your calendar.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALENDARSHOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Missed appointments or events due to extraction errors
• Damages resulting from third-party service issues
• Any damages exceeding the amount you paid us in the past 12 months

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless CalendarShot and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

12.2 Arbitration

Any dispute arising from or relating to these Terms or the service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the service.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the service at any time
• Change features, functionality, or availability of the service
• Impose limits on certain features or restrict access to parts of the service

We will make reasonable efforts to notify you of significant changes, but we are not obligated to do so.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CalendarShot regarding the service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

14.5 Survival

Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive termination of these Terms.
